BOC-3 Filing Explained: Process Agents in Plain English
The cheapest filing in your launch is also one of the two that can hold your authority hostage. Here is exactly what it does.

The short answer
- A BOC-3 designates a legal process agent in every state where you operate.
- Only a registered process agent (or a broker/forwarder for itself) can submit it — you cannot file your own.
- It is a one-time cost of roughly $25–$150 and stays on file as long as the agent keeps you listed.
- FMCSA will not activate operating authority without a BOC-3 on file.
The BOC-3 exists for one reason: if someone sues your trucking company in a state you passed through, there has to be somebody in that state who can legally accept the lawsuit on your behalf. The form designates those people. Once filed, it covers all 50 states and DC and does not need annual renewal.
What a process agent actually does
- Accepts service of legal process — lawsuits, subpoenas — on your behalf in their state.
- Forwards those documents to you at the address on file.
- Maintains your designation with FMCSA electronically.

Because the filing is trivially cheap, it is a favorite loss-leader for companies that then upsell you on unnecessary DOT compliance packages, "mandatory" drug program bundles, or overpriced UCR filings. Buy the BOC-3, decline the rest, and be extremely skeptical of anyone who calls you unsolicited within a week of your USDOT number issuing.

FMCSA publishes a list of blanket process agent companies. Choose one with 50-state coverage and a real support line.

Legal name, USDOT number, MC number if issued, and physical address — matching your Motus registration exactly.

Verify it posted
Check your record on the FMCSA licensing and insurance site. The BOC-3 should show as filed with your agent named. Do not take the vendor's word for it.
